New Jersey 代孕概况
"新泽西禁止代孕"是 1988 年的旧闻。In re Baby M 判于 1988 年 2 月 3 日,它判定无效的是一份传统代孕合同——当时怀孕的那位女性同时是孩子的基因母亲。这个判决至今仍然管着传统代孕;2018 年之前,法院也把这一立场延伸适用到妊娠代孕案件上。
Gestational Carrier Agreement Act(《妊娠代母协议法》)在 2018 年 5 月 30 日堵上了这个缺口:依该法订立的协议"符合本州的公共政策"。
- 在协议合规的前提下,亲权于孩子出生时依法自动归属准父母——法院的令状是确认它,而不是创设它。
- 准父母直接写进原始出生证明。不走收养,也不是事后修改。
- 对准父母不设居住、公民身份、婚姻或基因联系要求。
- 保险不被投保窗口卡住。 新泽西有自己的医保交易所,并且把「怀孕」本身算作合格生活事件——所以保险可以在孕期中途安排,而这在多数州只要错过开放投保期就办不到。
New Jersey 代孕法律
新泽西州的 Gestational Carrier Agreement Act(《妊娠代母协议法》)——P.L. 2018, c. 18,N.J.S.A. 9:17-60 至 -68,2018 年 5 月 30 日签署通过——明文宣告依该法订立的协议"符合本州的公共政策"(§ 9:17-61)。它适用于该日当天及之后签署的协议;截至 2026 年 7 月,我们没有查到任何修订。
已经确定的事
- 只管妊娠代孕。法条对妊娠代母的界定是"不使用她自己的卵子"受孕(§ 9:17-62)。传统代孕拿不到该法的任何保护,仍然适用 In re Baby M。该法出台之前,法院把这一立场也延伸到了妊娠代孕案件:拿不到真正意义上的产前亲权令(A.H.W. v. G.H.B.,Ch. Div. 2000),与孩子没有基因联系的准母亲被引去走收养(T.J.S.,App. Div. 2011;2012 年因最高法院意见平分而维持原判)。
- 亲权依法自动归属。在协议合规的前提下,"孩子一出生",准父母即为孩子的法定父母(已婚或有伴侣的,配偶或伴侣双方都是);代母和她的配偶都不是(§ 9:17-63(a))。
- 对准父母不设基因联系、婚姻、居住或公民身份要求。法条对"intended parent"(准父母)的定义明确涵盖单身者、已婚与未婚伴侣、民事结合与家庭伴侣、两位准母亲和两位准父亲,并且不要求任何一方提供配子(§ 9:17-62)。该法没有任何公民身份或移民身份要求;"居住"(residence)一词在全法只出现过一次——在管辖法院(venue)条款里。
- 这不是收养。一份有效的协议不构成收养,也不构成 Title 9 项下违法的监护权让渡或亲权终止(§ 9:17-68)。
- 什么时候提交、去哪里提交。代母怀孕之后,向高等法院衡平庭家事部(Superior Court, Chancery Division, Family Part)提交。三个县任选其一即可:预计分娩地、代母居住地,或准父母居住地。法院认定各方合规的,"应当签发"该令状(§ 9:17-67(a)、(f))。
- 原始出生证明上写的就是他们。州登记官"应当"签发(§ 9:17-67(g);R.S. 26:8-28(a)(3),经修订)。
实务中会有差异的事
- 时间点与出庭。法条没有规定要怀到第几周才能提交,这属于各县的做法差异。无争议的案件可以不经当事人本人出庭即行裁定——除非获得免除,你的律师仍然要出庭(§ 9:17-67(c)、(d))。
- 留给你的合同去约定的:托管,以及代母的保险——这两项该法都没有作出规定。
需要就个案征询意见的事
- 跨境与跨州安排。该法没有法律适用(choice of law)条款。准据法、管辖权,以及判决在你居住地能否获得承认,这几件事要由你的律师们放在一起分析;写一条适用新泽西法的条款、再加上与本州的真实连接,只是这项分析的起点,不是终点。
- 实验室差错。如果孩子最终与本应提供配子的那位准父母没有基因关系,在协议合规的前提下亲权依然成立——除非有基因父母在孩子出生后 120 天内提出异议(§ 9:17-63(b))。
- 不寻常的事实情形。截至 2026 年 7 月我们复核时,没有查到任何公开的上诉审判决对该法作出解释——对一套把卷宗封存起来的制度来说,这在意料之中(§ 9:17-67(e)、(h))。
- 待议中:A4646 与 S4274 分别于 2026 年 3 月和 5 月提出,拟只对代母增加居住或满 12 个月住所地的要求;截至 2026 年 7 月我们复核时,两案都还搁在委员会。
资格条件与协议本身 — §§ 9:17-64、9:17-65
签署协议时,代母必须年满 21 周岁、至少生育过一个孩子、已完成医学评估和心理评估,并且有她自己的律师,独立于准父母之外——费用可以由准父母承担。
准父母这边同样有条件(§ 9:17-64(b)):一次心理评估,加上你们自己的律师;已婚或有伴侣的,两个人都必须符合条件并签字。律师、医生和心理评估人员在任何一个州、美国属地或哥伦比亚特区持照都可以。
最容易踩的是时间点:必须在各项筛查之后、在任何以胚胎移植为目的的医疗程序之前签署。协议的必备条款包括:她对分娩和恢复期间医疗人员的选择权,以及准父母在孩子出生时即接受监护并承担抚养。合规的协议"推定可执行";不合规的,则由法院"依当事人的意思"认定亲权。

致准父母
新泽西的这部法律不问你住在哪里、拿哪国护照、结没结婚,也不问胚胎和你有没有基因关系。"居住"(residence)一词在全法只出现过一次——在管辖法院(venue)条款里。
它在签约之前确实要求的是:
- 一次心理评估。这是法条规定的条件,不是行业最佳实践——也最容易被漏掉。已婚或有伴侣的,两个人都要做,两个人都要签字。
- 你自己的律师,与代母的律师分开,在任何一个州或哥伦比亚特区持照都可以。实务上,亲权起诉状由取得新泽西州执业资格的律师提交。
- 管辖法院很少成为障碍。三个县任选其一即可:预计分娩地、代母居住地,或你自己的居住地。代母只要在新泽西分娩,单凭她这一侧就满足了"预计分娩地"这一项。
有一个规划上的优势值得早点知道。 孕期的医疗费总得有人保,而这个人通常是你。多数州的陷阱在于时机:万一代母的保单最后被认定不保代孕——这种情况不少——而你又刚好错过了开放投保期,那市面上根本就没有可买的交易所计划。你要么等到一月,要么去买专门的代孕医疗保单,费用高出一大截。新泽西把这个陷阱去掉了,因为在这里,怀孕本身就能开启投保。它去不掉的是审核那一步——能投保,不等于这份保单就保代孕妊娠——但「至少有得选」,正是让一次年中的除外责任不至于变成五位数窟窿的关键。
New Jersey 代孕费用
花费取决于胚胎是否已经就绪、是否需要捐卵。以下是 Ivy 自己截至 2026 年 7 月的报价区间,不是全州平均水平。
- 代孕旅程本身(约 $140,000–$150,000)。机构服务费、代母报酬、法律与托管服务、健康保险——覆盖从匹配到产后照护的全程,新泽西的亲权申请是其中一项标准的法律费用。
- 试管与胚胎培育(约 $40,000,由诊所收取)。促排、取卵、胚胎培养、移植,以及可选的 PGT-A 检测。
- 捐卵(如需要,约 $30,000 起)。捐卵人协调、补偿、法律工作及相关开支。

你的资金存放在独立的托管公司或律师信托账户,绝不放在机构自己手里——原因见为什么机构自营托管是危险信号。
New Jersey 代孕流程
新泽西真正不一样的环节是筛查、合同和亲权。
- 匹配。代母住在哪里、预计在哪里分娩,就是你的律师要分析的"与新泽西的连接"。
- 筛查。她的医学评估和心理评估——还有你的。全部完成之后,才轮到任何人签字。
- 签约。双方各请各的律师,各自提交一份代理宣誓书。签署时点在筛查之后、任何以移植为目的的医疗程序之前。
- 周期与移植。走移植周期方案;代母不做取卵。
- 提起亲权之诉。她怀孕之后,你的律师向高等法院衡平庭家事部提交起诉状,随附双方的宣誓书和诊所出具的书面说明。
- 亲权令。加急审理、不公开开庭;无争议的案件可以不经当事人本人出庭即行裁定。
- 出生登记。分娩后不久提交;目标是在临产之前就把令状拿到手。
多数旅程全程一到两年。
致代母
新泽西把你的几项保护直接写进了法条。
- 你自己的律师,独立于准父母之外——这是该法的强制要求;费用可以由准父母承担。
- 医疗人员由你挑选:分娩和恢复期间照护你的人由你来定,书面通知即可,不需要他们批准。
- 在协议合规的前提下,你自始就不享有需要签字放弃的亲权(§ 9:17-63(a))。该法的各项要求没有满足的,则改由法院认定亲权。
- 你始终是那个病人——这一条来自一般的知情同意法,不是该法:合同条款可以设定预期和违约救济,但不能强迫你接受某项医疗程序,也不能把你的同意权转让出去。
- 你的保险需要专门审核——很多孕产险把代孕列为除外责任。在 Ivy,这项审核在匹配阶段就做。
- 在新泽西,怀孕之后仍然可以投保 ACA 医保。 多数州做不到这一点:联邦层面并不把「怀孕」算作合格生活事件,你只能等到开放投保期。新泽西有自己的交易所,把怀孕算了进去,而且官方明确写着怀孕「可以在整个孕期内随时申报」——不是只有 60 天窗口——生效日期还可以致电客服中心往前追溯。万一保单最后被认定不保代孕,这就是一扇实打实的备用门。
New Jersey 代母申请条件
新泽西法律本身只要求这几条:签署协议时年满 21 周岁、此前至少生育过一次、完成医学评估和心理评估,以及有你自己的律师。其余标准来自诊所和机构:
- 年龄 20 到 36 岁。满 20 岁即可申请——筛查和匹配要花上几个月——但协议要等你满 21 周岁才能签。年龄上限反映的是孕期安全,以及诊所和准父母实际能接受的范围。
- 至少一次健康足月的自己的分娩,且正在抚养自己的孩子。
- BMI 不超过 32。
- 剖腹产不超过 2 次、总分娩不超过 5 次——这是试管医生普遍的门槛。
- 不吸烟、不用电子烟、不使用 THC——至少 6 个月无接触,由诊所检测验证。
- 经济状况稳定,不依赖公共援助。
- 美国公民或永久居民(绿卡),生活状态稳定。
该法没有针对代母的居住要求,不过有一项待议的法案打算加上。顺产的话,产后 3 个月即可申请;剖腹产恢复期更长,具体时点由诊所判断。别自己先放弃,先来问:代母常见问题、申请表。
New Jersey 代母报酬

关于新泽西,有一点如实说明:法条本身用的词是"合理开支"(reasonable expenses)——这是一个界定得很宽的类别,涵盖医疗、法律和心理咨询费用,以及贯穿孕期和产后恢复期的生活开支,可以付给你本人,也可以代你支付——法条同时确认,这些款项不违反本州关于收养付款的法律(§ 9:17-68(b))。有偿的妊娠代孕在新泽西早已是成熟做法;至于你这份协议在法条之下具体怎么搭结构,那是你自己的独立律师要在你签字之前向你解释清楚的事。

- In re Baby M, 109 N.J. 396 (1988) — Supreme Court of New Jersey, decided February 3, 1988, official text via the Harvard Caselaw Access Project. A traditional surrogacy case — the woman carrying was artificially inseminated and was the child's genetic mother. The Court invalidated the contract "because it conflicts with the law and public policy of this State," finding "the payment of money to a 'surrogate' mother illegal, perhaps criminal, and potentially degrading to women," and identified conflicts with laws prohibiting money in adoption, requiring proof of unfitness or abandonment before termination of parental rights, and making surrender of custody revocable in private placement adoptions. The Court found "no offense to our present laws where a woman voluntarily and without payment agrees to act as a 'surrogate' mother, provided that she is not subject to a binding agreement to surrender her child," and stated that its holding "does not preclude the Legislature from altering the current statutory scheme ... so as to permit surrogacy contracts" — the invitation the 2018 Act answered
- A.H.W. v. G.H.B., 339 N.J. Super. 495 (Ch. Div. 2000) — Superior Court of New Jersey, Chancery Division, Family Part, Bergen County, decided April 4, 2000; official text via the Harvard Caselaw Access Project. A gestational case — a sister carrying for her sister and brother-in-law, the intended parents genetically related — in which the court denied a true pre-birth order: "A court order for the pre-birth termination of the pregnant defendant’s parental rights is the equivalent of making her subject to a binding agreement to surrender the child and is contrary to New Jersey statutes and Baby M." Cited for the pre-2018 position only; the 2018 Act supersedes it for compliant gestational carrier agreements
- In re Parentage of a Child by T.J.S., 419 N.J. Super. 46 (App. Div. 2011) — Superior Court of New Jersey, Appellate Division, decided February 23, 2011, affirmed by an equally divided Supreme Court, 212 N.J. 334 (2012); official text via the Harvard Caselaw Access Project. A gestational arrangement using an anonymous donor ovum, so the intended mother had no genetic link. The court held the "Parentage Act does not intend maternity in such a circumstance absent adoption," leaving a non-genetic intended mother off the birth certificate. Cited for the pre-2018 position only; the 2018 Act makes genetics irrelevant to intended-parent status
- New Jersey A4646 and S4274 (2026-2027 session) — proposed residency and domicile requirement for gestational carriers — New Jersey Legislature, introduced bill text. A4646 introduced March 10, 2026 (Assemblyman Gregory E. Myhre), referred to the Assembly Community Development and Women's Affairs Committee; companion S4274 introduced May 14, 2026 (Senator Carmen F. - P.L. 2023, c. 258 (A5235) — New Jersey infertility insurance mandate, amending N.J.S.A. 17B:27-46.1x — New Jersey Legislature, enacted chapter law, "Approved January 12, 2024." Section 4 amends section 4 of P.L.2001, c.236 (C.17B:27-46.1x). The act "shall take effect ... on the first day of the seventh month next following the date of enactment and shall apply to contracts issued or renewed on or after the effective date" — which is the source of the August 1, 2024 effective date. Applies to group policies providing hospital or medical expense benefits "for groups with more than 50 persons" that include pregnancy-related benefits. Required coverage includes "in vitro fertilization, including in vitro fertilization using donor eggs and in vitro fertilization where the embryo is transferred to a gestational carrier or surrogate," "four completed egg retrievals," and "unlimited embryo transfers, in accordance with guidelines from the American Society for Reproductive Medicine." The definition of infertility covers "the need for medical intervention ... either as an individual or with a partner" and closes: "Nothing in this definition shall be used to deny or delay treatment to any individual, regardless of relationship status or sexual orientation." Carve-outs include a religious employer exclusion and non-application to Medicaid and NJ FamilyCare contracts.
